MarloDee Designs is a licensed reseller for Raggedy Scrappin/Cheryl Seslar Designs so you must follow Cheryl Seslar's Terms of Use.
**NEW AS OF JUNE 12TH, 2010 - MARLODEE DESIGNS IS NOW AUTHORIZED TO SELL NON EXCLUSIVE CLIP ART COLLECTIONS FROM CHERYL WITH COMMERCIAL USE OK TERMS. She still requires specific licensing for commercial products created with her works to be sold on multi vendor sites. So, you need to visit her site to obtain the proper license if you are not selling your designs on a website/blog you own!

Non-Exclusive, Semi-Exclusive & Exclusive (Commercial Use OK! Now!) packages ::
All Cheryl Seslar Designs Clip art Collections are sold at MarloDee Designs for Commercial & Personal Use -
You may: Create items for your own personal use such as for your own website or blog design, printables you'd personally use, scrap kits for your own use etc. You may create items handmade or digital on your website, blog, Etsy store, Ebay store, Zazzle store & Cafepress store. You can create printables, scrap kits, websets, web graphics and auction templates. The key word here is SELL - NEVER GIVE YOUR CREATIONS AWAY FREE using Cheryl's clipart/artwork. You MUST own the website - it must be your Ebay, Etsy, Blog, Cafepress or Zazzle store! You can create items to be sold in a CD or digital - again as long as it is your site or store. Always provide your customer with a locked/flattened product. NO LAYERS! You customer must NOT be able to obtain Cheryl's artwork as is from your products. You MUST give Cheryl credit and state you got the clip art from MarloDee Designs. **Also - commercial digitizing requires a specific license from Cheryl - please visit her site to obtain the proper licensing.
You may NOT: If you are wanting to sell on MULTI VENDOR sites (sites owned by someone else other then you) YOU NEED TO MAKE SURE you have the proper license from Cheryl. She has many licenses now and she has specific licenses for specific sites. Otherwise - you will create - add product only to have them removed for not having the right licensing. So, please visit her website to look at her Professional licenses to see what you need in order to create and sell commercial products. Do NOT share or give away her clipart. You can NOT just add the clipart to a digi scrap package as is and call it an element or sticker - YOU MUST create something new from her designs. (adding a white background does not make it new either) You can NOT share your designs free with anyone. No forums, membership sites, groups or multi vendor sites (unless you have one of her special licenses). She is opening up her terms - but please let's follow them so she doesn't close the door in frustration. Always ask - don't ever assume. So, if you don't see your answer listed here - do NOT assume it is ok. Send me an email to ask!
***Cheryl has many different types of commercial licensing she is now offering. So, visit her site - she does allow embroidery digitizing - I think you may need a license from her in order to sell the patterns. The clipart/graphics I have of hers in my commercial area does NOT need additional licensing to use. So, you can make items (digital and printed) to sell on your website. And you can make digitized embroidery patterns as well. The only ones you would need additional licensing for is the clip art collections that are listed Non Exclusive. Those will require additional licensing from Cheryl. If you are still not sure what you can and can't do - please email me. We need to make sure we are all in compliant with her terms!
You must credit to Cheryl and include a link to Cheryl Seslar's website (www.cherylseslardesigns.com) when using Exclusive, Non Exclusive and Semi Exclusive Cheryl Seslar Designs Clip art.
Personal OR Commercial use is allowed. Yes! You can make items - either handmade or digital to sell with the clip art listed here (again Cheryl's terms a different - make sure you are selecting her Commercial ok packages or that you have her Commercial license). Yes! You can create digital printables, quick pages, greeting cards, stickers, note cards, invitations, business cards, t-shirts, mousepads, coffee mugs, posters and even shoe designs. You can hand make items to sell as well. The key here is you MUST MAKE SOMETHING NEW from the clip art.
If selling digital items you made with the clip art - you MUST give your customer a locked/flattened image. NO LAYERS! Your customer must not be able to obtain the clip art in original form to use for themself as is or share.
If making a digital scrapbook kit (or quick pages) - you can NOT just add the clip art to the packages as is and call them elements. That is the same as reselling as is - which is NOT allowed. You need to turn the clip art into something NEW - acrylic, stickers or flattened into a background - before adding to the kit. Quick pages - again the clip art must be flattened to the background - NO clip art as is but labeled as elements.
NO RECOLORING. Do not change the colors or recolor to create new clip art, graphics or designs to use or sell. This is a violation to most artists. Do not ask me to ask the artist if it is ok. They will most likely say no. You wouldn't ask Van Gogh if you could change the color of his grass in a painting so it would match your home decor? The same thing.
You may NOT make printables, web sets, scrap kits, etc. and share or give them away in online or offline groups / forums or membership sites. You are allowed ONLY to give away an occasional printable, web set, scrap kit, etc only on your own website or blog for the purpose of a business sample or promotion unless you have previously received special written permission for any other avenues. This will help protect those who run a business trying to sell printables, web sets, scrap kits, incredimail stationery etc. because if there aren't so many freebies floating around, you will be able to sell more.
You may NOT sell or give away the clip art “as is”. You may NOT share or give away any graphics purchased from my site with any other person or online groups / forums. You must create something new that you intend to sell or use for your own personal use.
You may use the clip art to create all printables, for digitizing (embroidery patterns), web designs, and any other project as long as it's your own creation and you're not including the original clip art "as is". (PLEASE - THIS HAS BEEN UPDATED SINCE THE TERMS OF USE I HAVE ADDED TO MY CLIPART PACKAGES - SO THIS IS THE UPDATED NEW VERSION. YES - YOU CAN MAKE DIGITZED EMBROIDERY PATTERNS WITH THE CLIPART. A lot of the artists now are allowing this. So, it is time I allow it too!)
Updated - NO MEMBERSHIP SITES. If you are creating products that are to be offered on a site where it requires the artist or myself to sign up to see how the artwork is being used - then it is NOT allowed. (whether site the membership is free or not) -
Again - if you have questions, don't see your project listed above or are confused with my wording - please don't hesitate to email me. I would rather we figure this out from the start then have you do what you are going to do -you spend all that time creating/designing - only to find out later it can't or shouldn't be done. You MUST give credit by linking to my site (www.marlodeedesigns.com) and the original artist (link is in each product description). If you aren't allowed to provide a link (meaning the website is not owned by you), you MUST include the following statement in the product description or in your terms of use file: "Original Artwork by "Name of Artist" and purchased at MarloDee Designs (www.marlodeedesigns.com)."
EMBROIDERY DESIGNS TERMS OF USE/POLICIES ::
All of the embroidery designs I have listed can be used for personal use (to make your own items with your own machine/software for yourself or to give as gifts) OR commercial use (to make items with your own machine/software to sell online/ebay/etsy/craft stores or in a booth/craft show/mall or store) OR for your Zazzle store.
All of the embroidery files I have posted will come in a DST format (when uploading to Zazzle - Zazzle will automatically convert it to an OFM file so you can use it). The DST files do NOT have colors assigned to the threads/design/stitching. Which means these are basically colorless and will require for you to assign colors with your own software/machine or through your Zazzle store. I do NOT have any means to convert these files to any other file format. Please do not ask me to do so - your request will be ignored. I can NOT convert files at this time either.
You can NOT sell these designs as is, converted or colored digitally at all. These files can ONLY be used to make items or use in Zazzle. NO SHARING! You can NOT share these to anyone else - no freebies - offering in groups/membership sites or on a CD collection. NO DIGITAL selling or sharing of any kind.
These can NOT be used for mass production without a prior contract/written consent. You MUST contact me if you want to use this for productions of more then 50 of the same items of the same design in the same printing. (unless it is a Zazzle customer purchasing from you - then congratulations to you!)
I do NOT offer nor provide support, software or instructions with these designs. You should have some idea how to use a DST/OFM file in your machine/software. Using in Zazzle is pretty basic and Zazzle will walk you through it.
I offer NO REFUNDS for digital design purchases UNLESS you can provide proof to me that the design will not work with your machine or Zazzle sends you an email that they can not use the file. I will require proof before I can offer a refund for the design purchase price. I will only refund the purchase price of the design itself. NOTHING ELSE. (note: not working with your machine means - that your machine does accept DST files and you receive an error message when using it - does not mean - I bought this design and my machine does not accept DST files - that is up to you to find that out before buying)
MarloDee Designs will not be held liable for any monetary losses or consequential damages as a result of using any of my embroidery DST designs.
I created these files using a software program that has a wizard converter program. These are not/or were not created with knowledge of cleaning up stitches/or patterns. I created these for my Zazzle store using basic designs that seemed to come out looking good. I use all of these designs in my store and have yet to receive a notice from Zazzle that they do not work. So, these designs are basic and simple designs that you can use/tweek for your business or Zazzle store. I decided to allow others to save a ton of money with converting (and time) by offering what I have created.
